This Disclaimer applies to the noxtica.com website, the demo, the documentation, the blog, the Backoffice, the APIs, the SDKs, the hosted verification flows, all AI Features and every other service operated by Noxart Games Co. (“Noxtica”, “we”, “us”, “our”) (together, the “Services”), and to every result, score, signal, label, listing, report, answer and other content that they produce or display (“Output”). It forms part of our Terms of Service. Capitalised terms not defined here have the meaning given in the Terms of Service.
Every statement in this Disclaimer applies to the maximum extent permitted by applicable law. Nothing in it excludes or limits any right or liability that cannot be excluded or limited by law.
1. Research, Listings and Information Only
1.1 The Services and all Output are provided for research and general informational purposes only. They include automated signals, listings, compilations of data from our own systems and from third-party and public sources, and content generated by software.
1.2 Output is not legal, regulatory, compliance, financial, investment, tax, accounting, credit, insurance, employment, security, identity or any other professional advice, and must not be treated as such. No professional, advisory, fiduciary or client relationship is created between you and Noxtica by your use of the Services.
1.3 Output is not a statement of fact, a certification, an attestation, an audit, an opinion or a decision. It does not determine whether any person, business, device, document, session, payment or transaction is genuine, legitimate, human, fraudulent, sanctioned, risky, eligible or safe.
2. No Guarantee
2.1 We give no guarantee, warranty, representation or condition of any kind, express or implied, about the Services or any Output. In particular, we do not guarantee that Output is accurate, complete, current, reliable, unbiased or fit for any purpose, that the Services will detect or prevent any bot, fraud, attack, impersonation, forged document, sanctioned person or other threat, or that the Services will be available, uninterrupted, secure or error-free.
2.2 Figures that we publish or mention about accuracy, detection rates, coverage, latency or performance are estimates measured under particular conditions. They are not promises and your results will differ.
2.3 Prices, plans, product descriptions, feature availability and other information on our websites may contain errors and may change at any time without notice.
3. You Must Verify Independently
3.1 Before you take any action or make any decision that relies on, or is influenced by, any Output or any content of the Services, you must independently verify the relevant information against original, primary and official sources. Examples include the authority that issued an identity document, the official sanctions lists published by the relevant governments and international bodies, official company and business registries, court and regulatory records, and the original publisher of any data or article.
3.2 Third-party and public data sources (including sanctions, politically-exposed-person, watch-list, adverse-media, registry and device-intelligence sources) can be incomplete, delayed, inaccurate, mismatched or unavailable. A “no match” does not mean that no risk exists. A “match” does not mean that the person or business is the one listed.
4. Probabilistic Scores and Verification Results
4.1 Device fingerprinting, bot detection, fraud and risk scores, document checks, liveness, face matching, age estimates, business and merchant checks, screening matches, monitoring alerts and similar Output are probabilistic. They will produce false positives and false negatives, can be evaded or manipulated, and vary in accuracy across devices, documents, countries and populations.
4.2 Any decision to approve, decline, block, restrict, flag, review, report or otherwise act in relation to a person or business is made solely by the customer who uses the Services, not by Noxtica. Customers must ensure that a qualified human reviews any adverse decision that significantly affects a person or business, and that affected persons can obtain an explanation and contest the decision where the law requires.
4.3 Noxtica is not a consumer reporting agency, credit bureau or background-check provider, and Output must not be used as a factor in determining any individual’s eligibility for credit, insurance, employment, housing or similar purposes.
5. AI Features and AI Output
5.1 Some features of the Services use machine learning, large language models or automated agents, which may be provided by third parties. AI Output is generated automatically and is not reviewed or verified by Noxtica. It may be inaccurate, incomplete, outdated, biased, offensive or entirely fabricated, even when it sounds confident or cites sources.
5.2 Do not rely on AI Output for any decision. Treat it as a draft that requires your own checking against original sources and your own judgement. You are responsible for your prompts and inputs, for any actions you allow an AI agent to take, and for how you use AI Output.
5.3 When you interact with an AI assistant in the Services, you are interacting with an AI system, not a human.
6. Third-Party Services and Links
6.1 The Services rely on third-party infrastructure, networks, AI models, payment providers, data sources and other services. We do not control them and, to the maximum extent permitted by law, we are not responsible for their availability, accuracy, security, outages, changes or acts and omissions.
6.2 Links to third-party websites or resources are provided for convenience only. We do not endorse them and are not responsible for their content, policies or practices.
7. Documentation, Blog and Website Content
Documentation, articles, guides, whitepapers, sample code, comparisons and other content are provided for general information only, may be outdated or incomplete, and may not suit your situation. Sample code is provided “as is” and may not be suitable for production use. Mentions of laws or regulations are general descriptions only and are not legal advice; consult a qualified professional in your jurisdiction.
8. Your Responsibility
You are solely responsible for your use of the Services and any Output, for every decision you make and action you take, for your compliance with all laws that apply to you (including data protection, biometric, consumer protection, anti-discrimination, financial-services, anti-money-laundering and sanctions laws), for having a lawful basis and any required consents, and for giving the people whose data you process all required notices. You use the Services and any Output at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NOXTICA AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING FROM ANY USE OF, OR RELIANCE ON, THE SERVICES OR ANY OUTPUT, OR FROM ANY DECISION MADE OR ACTION TAKEN OR NOT TAKEN IN RELIANCE ON THEM. Where you have an agreement with us, the limitations in our Terms of Service also apply. Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited under applicable law.
10. Language; Controlling Version
Only the English version of this Disclaimer is legally valid and binding. The controlling version is the English text published at https://noxtica.com/disclaimer. Any translation of this document (including any machine translation) is provided for reference purposes only, does not have any legal value, should not be relied upon as a legally binding document, and creates no obligation or responsibility for Noxtica. In the event of any discrepancies or inconsistencies between a translation and the English version, the English version shall prevail.
